OHCA ISSUES NOVOS TO TWO COMMUNITY CARE FOSTER FAMILY HOME OPERATORS
HONOLULU — The Hawai‘i Department of Health (DOH) Office of Health Care Assurance (OHCA) has issued a Notice of Violation and Order (NOVO) against Chita Madariaga, a Community Care Foster Family Home (CCFFH) operator located in Wailuku; and against Medy Madrid Simmons, a CCFFH operator located in Waiʻanae, due to serious and substantiative violations of Hawaiʻi Administrative Rules (HAR) 11-800.
Nursing consultants from DOH contractor Community Ties of America (CTA) confirmed that in two separate and unrelated incidents, Madariaga and Simmons left CCFFH clients with unqualified adults who were not certified caregivers.
Both Madariaga and Simmons have been fined $500 each. Madariaga and Simmons have 20 days from the date of receipt of the NOVO to submit a written request for a hearing, or the NOVO will become final and enforceable after the 20-day period.
The DOH Office of Health Care Assurance, State Licensing Section, through its contractor CTA, certifies and regulates CCFFHs to ensure the health, safety and welfare of individuals residing in healthcare facilities.
